Terms of Service
The terms that govern use of this website and the A.I. voice agent services Telpro provides.
Acceptance of these terms
By accessing this website or engaging Telpro to provide services, you agree to these terms. If you do not agree, please do not use the site or our services.
Services
Telpro designs, builds and operates A.I. phone agents and related integrations. The specific scope, deliverables, fees and timelines for any engagement are set out in a separate written proposal or service agreement, which takes precedence over these terms where they conflict.
Descriptions, metrics and examples on this website are illustrative. Results depend on your call volume, industry, script, integrations and how the agent is configured, and are not guaranteed.
Your responsibilities
You are responsible for the accuracy of the business information you provide for agent training, for holding the rights to any content, phone numbers or contact lists you supply, and for the lawfulness of the campaigns you ask us to run.
You are responsible for complying with the laws that apply to your calls, including telemarketing, consent, do-not-call, call recording and industry-specific rules. We will advise and build safeguards, but the obligation remains yours as the party placing or receiving the calls.
Acceptable use
You may not use our services to make unlawful, deceptive, harassing or fraudulent calls; to impersonate another person or business; to contact numbers you do not have a lawful basis to contact; or to circumvent do-not-call or consent requirements.
We may suspend or terminate services immediately if we reasonably believe they are being used in breach of this section.
Fees and payment
Fees, billing frequency and usage charges are set out in your service agreement. Invoices are payable on the terms stated on the invoice. Late payment may result in suspension of service after reasonable notice.
Intellectual property
This website, its design, code and content are owned by Telpro and protected by intellectual property laws. Your business data, call recordings, transcripts and contact records remain yours.
Telpro retains ownership of its underlying platform, tooling, prompts, methods and know-how, including improvements developed during an engagement, excluding your confidential information and data.
Third-party services
Our services integrate with third-party platforms such as CRMs, calendars, telephony carriers and scheduling tools. Those platforms are governed by their own terms, and we are not responsible for their availability, changes or acts.
Disclaimers and limitation of liability
The website is provided on an "as is" and "as available" basis without warranties of any kind to the fullest extent permitted by law. We do not warrant that the site or services will be uninterrupted or error free.
To the maximum extent permitted by law, Telpro is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our aggregate liability arising out of or relating to the services is limited to the amounts you paid to Telpro in the three months preceding the event giving rise to the claim.
Termination
Either party may terminate an engagement in accordance with the notice provisions of the service agreement. On termination we will provide a reasonable export of your call data and assist with transition of forwarded numbers.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The state and federal courts located in San Diego County, California have exclusive jurisdiction over any dispute.
Changes to these terms
We may update these terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
